Services may include short-term rentals, long-term rentals, event support, construction site rentals, emergency response, and related sanitation solutions.

All services are subject to availability, scheduling, and acceptance by the Company.

2. Rental Agreement

A rental agreement is formed once the Company confirms your order verbally, in writing, or electronically. The rental period begins on the delivery date and ends upon pickup of the equipment, unless otherwise agreed in writing.

The customer is responsible for ensuring accurate information is provided regarding location, access, rental duration, and intended use.

3. Pricing and Payment Terms

Pricing is based on factors including, but not limited to:

  • Type and quantity of equipment

  • Rental duration

  • Service frequency

  • Delivery location

  • Special requirements or additional services

All prices are quoted in U.S. dollars. Payment terms will be communicated at the time of booking. Failure to pay invoices in accordance with agreed terms may result in service suspension, removal of equipment, or additional fees.

Late payments may be subject to interest, collection costs, or administrative fees as permitted by law.

4. Delivery and Placement

Delivery dates and times are estimates and may be affected by weather, traffic, site conditions, or other circumstances beyond our control. The customer must ensure clear, safe, and legal access for delivery and pickup vehicles.

Once placed, equipment should not be moved without prior approval. Relocation requested by the customer may incur additional charges.

5. Customer Responsibilities

The customer agrees to:

  • Use the equipment only for its intended purpose

  • Prevent misuse, vandalism, or unauthorized access

  • Maintain clear access for servicing and pickup

  • Comply with all applicable laws, regulations, and permit requirements

  • Notify the Company promptly of damage, issues, or service needs

The customer is responsible for loss or damage beyond normal wear and tear.

6. Cleaning and Servicing

The Company provides scheduled servicing as agreed, which may include waste removal, cleaning, deodorizing, and restocking supplies. Customers must allow reasonable access for routine servicing.

The Company is not responsible for unsanitary conditions caused by misuse, overcrowding, vandalism, or restricted access.

7. Damage, Loss, and Liability

The customer assumes responsibility for rented equipment during the rental period. The customer may be charged for repair or replacement due to damage, theft, fire, vandalism, misuse, or negligence.

The Company is not liable for personal injury, property damage, or losses arising from improper use or circumstances beyond our control, except where prohibited by law.

8. Limitation of Liability

To the fullest extent permitted by law, Porta Potty Rental Company Southeast shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits or business interruption.

Our total liability, if any, shall not exceed the total amount paid by the customer for the specific rental giving rise to the claim.

9. Indemnification

The customer agrees to indemnify, defend, and hold harmless the Company, its employees, contractors, and affiliates from any claims, damages, losses, or expenses arising out of:

  • Customer’s use or misuse of equipment

  • Violation of these Terms

  • Failure to comply with applicable laws

  • Acts or omissions of the customer or third parties at the site

10. Cancellations and Changes

Cancellations or changes must be requested in advance. Cancellation fees may apply depending on timing, equipment reserved, and delivery status.

Same-day cancellations or refused deliveries may result in full or partial charges.

11. Permits and Compliance

The customer is responsible for obtaining any required permits, approvals, or permissions related to placement and use of rented equipment. The Company is not responsible for fines or penalties resulting from permit violations.

12. Force Majeure

The Company shall not be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, severe weather, labor disputes, government actions, or equipment shortages.
